1. ABOUT THIS PRIVACY POLICY

Just Swap (“Just Swap”, “we”, “us” or “our”) is a digital platform operated by Puurnam Circularity LLP (“LLP”), a limited liability partnership incorporated under the laws of India.

This Privacy Policy explains how Just Swap collects, uses, stores, discloses and otherwise processes personal data when you access or use the Just Swap website, applications, digital interfaces, Platform Services, Assisted Services and related features (collectively, the “Platform”).

This Privacy Policy should be read together with the Just Swap Terms of Use and any applicable service-specific terms or policies.

Just Swap processes personal data in accordance with Applicable Law, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and rules made thereunder, to the extent in force and applicable.

Where consent is required under Applicable Law, the applicable consent mechanism will be used.

2. PERSONAL DATA WE COLLECT

The personal data collected depends on how you use the Platform and the services you choose to use.

We may collect:

2.1 Account and contact information

Your name, mobile number, email address, Account information and other information required to create or manage your Account.

2.2 Listings and Content

Information contained in Listings, Community Content and other Content submitted through the Platform, including descriptions, questions, requests, recommendations, contact details, photographs, images, videos, stories, announcements, events, comments, reviews and ratings.

Where you participate in Community, Just Swap may also process information relating to your designated community or locality, reports or complaints submitted through Community, and information relating to interactions with Community features.

Where you use Assisted Services, this may also include information and photographs collected or created in connection with the applicable service.

2.3 Location information

Location information provided by you or obtained from your device where you enable the relevant device permission.

Location information may be used for location-based features, including identifying Listings or services relevant to your location and determining service availability or service areas.

The specific location information collected will depend on the feature used and the permissions provided by you.

2.4 Transaction and payment information

Information relating to Plans, Assisted Services, Business Clear-Outs and other paid services, including transaction details, payment status, refund information and related records.

Payments may be processed through third-party payment providers, including Razorpay. Payment information processed directly by a payment provider may also be subject to that provider’s terms and privacy practices.

Just Swap does not collect or store payment credentials such as card numbers, CVV or UPI PIN through the Platform payment interface.

2.5 Communications and support information

Information contained in communications you send to Just Swap, including enquiries, requests, complaints, grievances and other communications relating to the Platform or its services.

Where you communicate with another User through an external platform such as WhatsApp, that communication is subject to the privacy practices of the relevant external platform.

2.6 Technical and usage information

Technical and usage information necessary for operating, securing and maintaining the Platform, which may include device information, browser or application information, IP address, access information, logs and information concerning your interaction with Platform features.

The specific technical information collected will depend on the Platform features and technologies actually used.

3. HOW WE USE PERSONAL DATA

Just Swap may process personal data for purposes including:

(a) creating and managing Accounts;

(b) providing and operating Platform Services;

(c) enabling Listings, discovery, matching and communication between Users;

(d) providing Assisted Services, including Home Clear-Outs and Business Clear-Outs;

(e) processing Plans, payments, refunds and other paid services;

(f) providing customer support and responding to communications and grievances;

(g) operating, maintaining, securing and improving the Platform;

(h) preventing, detecting and addressing fraud, misuse, security incidents and violations of the Terms or Applicable Law;

(i) administering User Content, Listings, Community Content, reviews, ratings and Soul Stories in accordance with the Terms, this Privacy Policy and Applicable Law;

(j) operating Community features, including receiving, categorising, organising, displaying and facilitating access to Community Content within the applicable designated community;

(k) processing reports, complaints and moderation-related information relating to Community Content and Platform activity;

(l) contacting, onboarding and processing information relating to Community Service Providers, including information required for applicable verification, service provision, paid visibility and Plan administration;

(m) publishing, displaying, adapting and using Soul Stories and other Content in accordance with the rights granted under the Terms;

4. CONSENT AND OTHER PERMITTED PROCESSING

Just Swap processes personal data only for lawful purposes and in accordance with Applicable Law.

Where processing is based on consent, the applicable consent mechanism will be used for the relevant purpose.

Where processing is permitted or required without consent under Applicable Law, Just Swap may process the relevant personal data on that basis.

Where consent is required, you may withdraw consent through the applicable mechanism, subject to any consequences of withdrawal and any processing that Just Swap is permitted or required to continue under Applicable Law.

5. HOW WE SHARE PERSONAL DATA

Just Swap may disclose or make personal data available where necessary for the purposes described in this Privacy Policy, including to:

(a) service providers and technology providers supporting the Platform;

(b) payment service providers, including Razorpay, in connection with payments and related transactions;

(c) hosting, infrastructure, security, communication and other service providers used in operating the Platform;

(d) external communication platforms where you choose or consent to communicate through such platforms;

(e) professional advisers, auditors or service providers where necessary for legal, business or compliance purposes; and

(f) government, regulatory, law-enforcement or judicial authorities where required or permitted by Applicable Law.

Just Swap does not sell personal data as a standalone commercial product.

Just Swap does not disclose personal data to unrelated third parties for their independent marketing purposes except where permitted by Applicable Law and where any required consent or other legal basis exists.

6. INFORMATION VISIBLE TO OTHER USERS

Just Swap is a platform through which Users may create and interact with Listings, Community Content and other Content.

Information included in a Listing or other Content may be displayed to other Users or made available through Platform features in accordance with the applicable feature and its design.

Community Content may be displayed to Users who are members of the designated community to which the Content relates. The persons who can access Community Content will depend on the applicable Community feature and Platform design.

You should avoid including unnecessary personal information in Listings, photographs, Community Content or other Content.

Just Swap does not require you to publish precise residential addresses in a Listing unless such information is necessary for a particular service or feature.

Information voluntarily shared by you directly with another User, including through an external communication platform, may be accessible to that recipient and is subject to the recipient’s handling of that information and, where applicable, the third-party platform’s terms and privacy practices.

Information relating to a person or business shared by a User through Community may be visible to other Users in accordance with the applicable Community feature. Users should not share another person's personal information unless they have the rights, authority or consent required under Applicable Law.

7. ASSISTED SERVICES AND BUSINESS CLEAR-OUTS

Where you use Assisted Services, including Home Clear-Outs or Business Clear-Outs, Just Swap may collect or create personal data and Content necessary to provide the relevant service.

This may include information about premises, items, photographs, Listing information, service requirements and communications relating to the service.

Such information may be used to provide and administer the relevant Assisted Service and related Platform functions.

8. SOUL STORIES AND CONTENT INVOLVING OTHER PERSONS

Soul Stories are voluntarily submitted by Users for publication through Just Swap.

By submitting a Soul Story, you grant Just Swap the rights and licence set out in the Terms to host, store, reproduce, display, communicate, publish, adapt and use the Soul Story and accompanying photographs or other Content for operating, providing, maintaining, displaying and promoting the Platform and its services.

No further approval or consent from you shall be required for Just Swap to publish or use a submitted Soul Story in accordance with the rights granted under the Terms and this Privacy Policy.

Where a Soul Story, photograph or other Content contains another person’s personal data, including the personal data of a child, the User is responsible for obtaining any consent, permission or other authorisation required from that person or their lawful representative under Applicable Law.

Where a Soul Story contains personal data or an image of a child, you must ensure that all consent and other requirements applicable to children under Applicable Law have been satisfied.

Just Swap may edit, format, crop, resize or otherwise modify a Soul Story in accordance with the Terms. Just Swap may decline to publish, remove or discontinue use of a Soul Story at its discretion or where required by Applicable Law.

9. DATA RETENTION

Just Swap may retain personal data for as long as necessary for the purposes for which it was collected or otherwise processed, including for providing services, maintaining Accounts and records, complying with Applicable Law, preventing fraud and misuse, resolving disputes, enforcing the Terms and protecting the rights and interests of Just Swap and Users.

Different categories of personal data may be retained for different periods depending on the purpose and applicable legal or operational requirements.

When personal data is no longer required, it may be deleted, anonymised or otherwise dealt with in accordance with Applicable Law.

Deletion of an Account does not necessarily require immediate deletion of all information.

10. DATA SECURITY

Just Swap may implement appropriate measures required by Applicable Law to protect personal data against unauthorised access, use, alteration, disclosure, loss or destruction.

No electronic system or method of transmission can be guaranteed to be completely secure. Accordingly, Just Swap does not guarantee absolute security of personal data.

You are responsible for maintaining the confidentiality of your Account credentials and should promptly notify Just Swap of any suspected unauthorised access.

11. THIRD-PARTY SERVICES AND EXTERNAL PLATFORMS

The Platform may use third-party services, including payment providers, hosting providers, communication platforms and other technology or service providers.

Third-party services may process information in accordance with their own terms and privacy policies.

Where you choose to communicate through WhatsApp or another external platform, that communication takes place outside the Just Swap Platform and is subject to the privacy practices of that external platform.

Just Swap does not control the privacy practices of independent third-party platforms, subject to Applicable Law.

12. YOUR RIGHTS AND CHOICES

Subject to Applicable Law, you may have rights and choices in relation to your personal data, including rights relating to:

(a) access to information about personal data processed by Just Swap;

(b) correction or updating of inaccurate or incomplete personal data;

(c) withdrawal of consent where processing is based on consent;

(d) deletion or erasure of personal data where applicable;

(e) grievance redressal; and

(f) other rights available under Applicable Law.

Requests may be made through the contact or grievance mechanism published by Just Swap.

Just Swap may require information necessary to verify the identity of the person making a request and may retain information where required or permitted by Applicable Law.

13. ACCOUNT DELETION

You may request deletion of your Account through functionality made available by Just Swap or through the applicable contact mechanism.

Account deletion does not necessarily result in immediate deletion of all information. Just Swap may retain information where required or permitted by Applicable Law or where necessary for security, fraud prevention, dispute resolution, enforcement of the Terms or maintenance of required business records.

14. COOKIES AND SIMILAR TECHNOLOGIES

The Platform may use cookies or similar technologies for operation, security, functionality, preferences, analytics or other permitted purposes.

The specific cookies or similar technologies used by Just Swap will depend on the technologies implemented on the Platform.

Where Applicable Law requires consent for particular cookies or similar technologies, the applicable consent mechanism will be provided.

15. CHANGES TO THIS PRIVACY POLICY

Just Swap may modify this Privacy Policy to reflect changes in the Platform, services, business practices, Applicable Law or regulatory requirements.

Where a change requires notice or consent under Applicable Law, the applicable notice or consent mechanism will be used.

The updated Privacy Policy will state its effective date.

16. GRIEVANCE AND CONTACT

Questions, requests and grievances relating to personal data or this Privacy Policy may be submitted through the grievance and contact mechanism published by Just Swap.

17. GOVERNING LAW

This Privacy Policy is governed by the laws of India.

Nothing in this Privacy Policy excludes or limits any right or remedy that cannot lawfully be excluded or limited.
